CONSTITUTION OF FORUM FOR DEMOCRATIC CHANGE

PREAMBLE


WHEREAS Uganda has had a history of political instability as a result of intolerance and lack of respect for the diversity of views in the country.

WHEREAS the political instability has manifested itself in violence leading to untold human suffering and economic mismanagement.

WHEREAS poverty, ignorance, disease has afflicted the people of Uganda as a result.

WE BEING COMMITTED to eradicating conditions which give rise to political instability and building a social-economic and political order which benefits all the people of Uganda.

DO HEREBY append our names, addresses and signatures to this Constitution and constitute ourselves into Founding members of the Forum for Democratic Change, a political party to do all such things as will further the aims and objectives of this Constitution which we now adopt for the Forum for Democratic Change.


CHAPTER ONE

NAME, LEGAL PERSONALITY AND HEADQUARTERS

The name of the Party shall be Forum for Democratic Change hereinafter called the Party.

1. The Party shall be a body corporate with perpetual succession and common seal, may sue, be sued and do such other things as a body corporate may lawfully do.

2. The Headquarters of the Party shall be situated in Kampala with branches in districts, constituencies and such places in Uganda and the diaspora, as the National Conference shall determine.

CHAPTER TWO

FLAG, EMBLEM, SYMBOL AND MOTTO

3. The Flag shall comprise the colors Sky blue, Red, yellow, green and in which shall be superimposed the hand showing the “V” sign being the symbol of the Party and a key as described and shown in the first schedule of this Constitution

4. The motto of the Party shall be “One Uganda, One People”

CHAPTER THREE

5. The goal of the Party shall be the establishment of a truly united and peaceful Uganda and the empowerment of the people of Uganda to determine a better quality of life for all Ugandans.

6. The aims and objective for which the Party is formed are to:
  1. Unite and facilitate reconciliation between and among the people of Uganda.

  2. Achieve sustainable peace, development, a culture of dialogue, compromise, tolerance and good governance.

  3. Eliminate inequalities created by mismanagement of public affairs by anyone.

  4. Fight poverty, ignorance, disease, and all forms of discrimination.

  5. Establish and maintain good relationships between Uganda and her neighbours, promote sub-regional and regional integration efforts

  6. Act as a platform to promote democracy, good governance, constitutionalism and rule of law.

  7. Enhance integrity, transparency, and accountability in the management of public affairs.

  8. Strengthen institutions of Government and promote the principle of separation of powers, and democracy.

  9. Pursue Constitutional, non partisan and professional management of the public service, the army, prison service, the police and other security organs.

  10. Encourage and support the continued existence of cultural and traditional institutions in the country.


  11. Establish a policy of zero tolerance on corruption.

  12. Engage in mutually beneficial relationships with international community.

  13. Support and promote the struggle for the rights of women, children, the aged, the disabled and all other marginalized groups.

  14. Cooperate with other organizations with similar objectives and where possible work jointly to achieve the said objectives.
7. (i) In an endeavor to ensure that women are adequately represented in all decision making structures, the party shall implement a programme of affirmative action including the provision of a quota of at least one third (1/3) in all its structures to enable such effective participation.

(ii) The method of achieving such implementation shall be detailed in all party guidelines on a continuing basis.

8. The guiding principles of the Party shall be:

  1. Good Governance, Democracy Social justice, transparency, accountability, honesty and integrity,

  2. Promotion and protection of the fundamental freedoms,

  3. Gender equality and equal opportunities for all in particular the youth, workers, women, the aged disabled persons and all other marginalized groups.

  4. Peaceful resolution of conflicts.

  5. Constitutionalism and rule of law for all.

CHAPTER FOUR

9. MEMBERSHIP

  1. Membership of the party includes the following categories

    1. Life membership

    2. Annual membership

    3. Corporate membership

    4. Honorary membership

    The National Executive Committee may from time to time determine other categories of the said membership


  2. Ordinary membership of the party shall be open to all Ugandans irrespective of sex, tribe, color, creed and economic status who accept its principles and programs, and are prepared to abide by its Constitution and rules.

  3. An applicant for membership of the Party shall complete a registration from specified in schedule 2 to this Constitution and submit it to the branch office or the headquarters of the party.

  4. Upon approval, payment of membership and subscription fees the relevant authority shall issue the member with a card.

  5. An ordinary member can apply for life membership according to regulations made by the National Council which may also bestow life membership upon persons who have made outstanding contribution in the development of the party

  6. The National Council on its own or on recommendation of any organ of the Party may grant Honorary membership to person who have demonstrated unwavering commitment and support to the party.

10. Rights

A member of the Party other than an honorary member shall have a right to:

  1. Take full and active part in the discussion, formulation and implementation of the policies of the Party in accordance with this constitution.

  2. Attend meetings and freely express views on any matter under discussion.

  3. Participate in any party activity through voting.

  4. Submit a question, petition or statement to any organ of the Party for consideration.

  5. Appeal against any decision made by any party organ against him/her where such appeal is expressly provided for by this constitution or any of its regulations.

11. Duties

It is the duty of every member to:

  1. Protect the name of the party.

  2. Work honestly and efficiently for the party.

  3. Promote the aims and objectives of the party.

  4. Register and vote.

  5. Pay his or her party dues.

  6. Canvass support for the party.

12. Cessation

Membership shall cease on occurrence of any of the following;

  1. Death of a member

  2. Resignation by a member in writing to the Secretary General

  3. Dismissal of a member by the party's recognized constitutional organ.

  4. If a member joins another party

  5. Provided that dismissal of a member under this article shall not bar a fresh application in respect of the same membership.

CHAPTER FIVE

ORGANISATION OF THE PARTY

13. The party shall have organs at both the local and National Level for its efficient organisation.


14. Local level Organization of the Party.

  1. POLLING AREA BRANCH

    1. Every polling station shall have a Party branch comprising all the members of the party resident in the polling area.

    2. The polling area party branch [hereinafter referred to as the Party branch] shall be the nucleus of the Party and every member desirous of becoming a party member shall do so by joining a polling area Party branch.

    3. For the avoidance of doubt in institutions of learning where there may be no villages, a cell or any such organizational unit shall constitute a Party branch and carry out such other functions as any other branch would have carried out.

  2. OPERATION OF THE POLLING AREA BRANCH

    1. Every party branch shall elect once in every four years, a Party branch committee at elections organized by the Party's National Council.

    2. The Party branch Committee shall comprise;

      1. The Party branch chairperson;

      2. The Party Branch Deputy Chairperson who shall be a woman member [save that the reservation of the deputy chair position for a woman shall not bar a woman member from vying for any other position in the Branch Executive]

      3. The branch Treasurer;

      4. the branch General Secretary;

      5. A secretary for each of the following portfolios: information and publicity, mobilization, health, education, environment, security, elders, research, development and veterans/pensioner

      6. The Branch Youth Leader;

      7. The Branch Woman Leader;

      8. The Branch Person with disability leader;

      9. Three other members one of whom shall be a woman;


      FUNCTIONS OF THE BRANCH COMMITTEE

    3. The Party Branch Committee shall be responsible for the general mobilization of the polling area at the polling area level and shall be responsible for the mobilisation of members to pay up their membership dues.

15. THE PARISH PARTY ORGANISATION

  1. The party shall have a parish party conference whose membership shall consist of all Party Branch committee members in the parish.


  2. The Parish Party Conference shall elect, at elections designated by the Party National Council the Party parish committee comprising:

    1. The Parish Committee chairperson;

    2. The Parish committee Deputy chairperson, who shall be a woman (save that the reservation of the Deputy Chair position for a woman shall not bar a woman member from vying for any position in the party parish committee);

    3. The Parish Treasurer;

    4. The parish General Secretary ;

    5. A secretary for each of the following portfolios : information publicity and mobilization, health , education, environment, security, elders and veterans/pensioner;

    6. The parish youth leader;

    7. The parish woman leader;

    8. The parish people with disability leader

    9. Four other members who shall be women

  3. FUNCTIONS OF THE PARTY PARISH CONFERENCE


  4. The party parish conference shall;
    1. Oversee the implementation of the party's programmes within the parish;

    2. Carry elections for filling up positions in the parish committees;

  5. FUNCTIONS OF THE PARTY PARISH COMMITTEE


  6. The party parish committee shall;

    1. Be responsible for the general administration of the party operations at the parish level;

    2. Transmit Party decisions from the National level to the branch;

    3. Advise on the implementation of party policies at the branches;

    4. Transmit information from the branches to the sub county committee and from the sub county committee to the branches;

    5. Supervise the collection of membership dues from the branches and hand over receipted dues to the district treasurer for banking;

    6. Supervise elections at the branches in the parish

    7. Coordinate the activities of the party in all branches

    8. viii. Receive monthly reports of the party's operations from all branches in the parish.

16. THE SUB-COUNTY PARTY ORGANISATION

  1. The party shall have a Sub-County Party Conference whose membership shall consist of all Party branch Committee members in the Sub-County;

  2. The Sub-County Party Conference shall elect, at elections designated by the Party National Council, the Party Sub- County committee comprising;

    1. The Sub-County Committee Chairperson;

    2. The Sub-county committee Deputy Chairperson, who shall be a woman[save that the reservation of the Deputy Chair position for a woman shall not bar a woman member from vying for any position in the Party Sub-county Committee;

    3. The Sub-county Treasurer;

    4. The Sub-county General Secretary;

    5. A secretary for each of the following portfolios: information and publicity, mobilization, health, education, environment, security, elders and veterans/pensioner

    6. The Sub-county youth leader;

    7. The Sub- county Woman Leader;

    8. The Sub-county people with disability leader.

    9. Four other members who shall be women.

  3. FUNCTIONS OF THE PARTY SUB-COUNTY

  4. CONFERENCE

    The Party sub-county conference shall;

    1. Oversee the implementation of the Party's programmes within the Sub-county;

    2. Coordinate the activities of the party in all the branches in the sub-county;

    3. Carry elections for filling up positions in the Sub-county committees;

  5. FUNCTIONS OF THE PARTY SUB-COUNTY COMMITTEE

  6. The Party Sub-county committee shall;
    1. Be responsible for the general administration of the party operations at the sub-county level;

    2. Receive monthly reports of the party's operations from all branches in the sub county;

    3. Coordinate the activities of the party in all branches in the sub county.

    4. Transmit Party decisions from the National level to the branch;

    5. Advise on the implementation of Party policies at the branches;

    6. Transmit information from the branches to the district committee and from the district committee to the branches;

    7. Supervise the collection of membership dues from the branches and hand over receipted dues to the district Treasurer for banking;

    8. Supervise elections at the branches in the sub county;

17. THE PARTY CONSTITUENCY CONFERENCE
  1. Elect party parliamentary committee comprising ;

    1. Chairperson;

    2. Deputy chairperson who shall be a woman(save that the reservation of deputy chair for a woman shall not bar any woman from vying for any other position on the committee);

    3. The Treasurer;

    4. The General Secretary;

    5. A secretary for each of the following portfolios : information and publicity, mobilization, health , education, environment, security, elders and veterans/pensioner

    6. Constituency Youth Leader;

    7. Constituency women leaders;

    8. Four other members who shall be women;


  2. During an electoral year, nominate party candidates for the position of parliamentary candidate; district council candidate for the sub countries under the constituency; propose names for position of district chairperson and women parliamentary candidate and any other candidate for adoption by the party District committee;

  3. Receive reports on work of the party in the constituency;.

  4. Make recommendations on the work of the party in the constituency;

  5. Generally supervise the work of the constituency, sub county and branch committees.

  6. FUNCTIONS OF THE PARTY CONSTITUENCY COMMITTEE:

  7. The party constituency committee shall;

    1. Oversee the working of the party in the constituency;

    2. Oversee the implementation of party programmes in the constituency;

    3. Transmit to and receive from Sub county committees reports of the party’s national programmes;

    4. Transmit to the National secretariat the results of the constituency nominations of party candidate during each electoral year.

18. DISTRICT CONFERENCE

  1. There shall be a District Conference comprising of the following;
    Committee members of the Party constituency committees.

  2. Party members of Parliament from the district

  3. Party members of the District Council

  4. There is established a District Executive Committee for each District, which shall comprise of:

    1. Chairperson

    2. Deputy Chairperson who shall be a woman.

    3. Secretary

    4. Treasurer.

    5. A secretary for each of the following portfolios : information and publicity, mobilization, health , education, environment, security, elders and veterans/pensioner

    6. One representative of District Youth League

    7. One representative of District Women League

    8. One representative of District Worker's solidarity

    9. One representative of District Groups of persons with Disabilities

    10. Four other members who shall be women

    FUNCTIONS OF THE PARTY DISTRICT COMMITTEES

    The Party District Committee shall;

    1. Review the party's work in the District and make appropriate recommendations to the National Council through the Executive Committee;

    2. Report any acts of indiscipline by any party member to the national secretariat for onward transmission to the Party Disciplinary Committee;
4. The chairperson the committee shall convene meetings of both the conference and the committee


19. THE NATIONAL COUNCIL

There shall be a National Council of the Party consisting of

All Party officials elected by the National delegates Conferences

All members of parliament

Two persons per each special group elected by their structures

Three deputy presidents one of whom shall be a woman

Two members elected by the Party constituency conference one of whom shall be a woman.

Eminent persons of the party not exceeding ten elected by the delegates conference.

FUNCTIONS OF THE NATIONAL COUNCIL.

  1. Act for and on behalf of NDC in such matters as the conference may determine.

  2. Implement the decisions of National Delegates Conference.

  3. Oversee the work of the women league, the youth league and the persons with disability.

  4. Issue documents and other policy directives as and when it sees fit.

  5. Receive reports, supervise work and delegate such functions of the National Executive committee it considers necessary.

  6. Oversee the execution of the directives and policies of the National Conference.

  7. Generate the policy for consideration by the National delegates Conference

  8. Approve the budget of the Party

  9. Supervise and direct the work of NEC and other party organs

  10. Ensure that branches function democratically and effectively

  11. Make rules and regulations

20. THE NATIONAL EXECUTIVE COMMITTEE

  1. There shall be an Executive Committee comprising of the following:

  2. The President
    Deputy Presidents (3)
    Secretary General
    Deputy Secretary general (Policy and Research)
    Deputy Secretary general (Administration))
    Treasurer General
    Deputy Treasurer General (Budget)
    Deputy Treasurer General (Fundraising)
    Organizing Secretary
    Publicity Secretary
    Secretary women's affairs
    Secretary for youth
    Secretary for disabilities
    Secretary for Regional and International Affairs.
    Secretary for Legal, Human rights and constitutional Affairs.
    Secretary for environment
    Secretary for labour
    Secretary for economic and investments
    Secretary for defence and security
    Secretary for culture, ethics and religious Affairs
    Secretary for Internal Affairs
    Secretary for Rural Development
    Secretary for Veterans , Ex- service men and pensioners
    Secretary for Health
    Secretary for communication
    Four Committee members elected by the National Delegates Conference.

    1. All members of parliament shall be members of the National Executive Committee

    2. A deputy secretary shall attend National Executive Meeting in absence of the respective secretary

    3. Each secretary shall present a quarterly report to the National Executive Committee

  3. Members of the Executive Committee shall be elected by the National Conference.

  4. The functions of the Executive Committee are:

    1. Originate policy for consideration by the National Executive Council.

    2. Supervise the National Secretariat

    3. Implement decisions of the National Conference and National Council

    Issue and send directives and instructions to and receive reports from the Districts.

    Suspend or dissolve any District committee where necessary and call for a new election where there has been a breach of this constitution or disregard of democratic principles.

    Manage and control all national and international property and other assets of the party.

21. STEERING COMMITTEE
  1. There shall be a steering committee of the National Executive committee which shall comprises of the President, Vice Presidents, Chairperson, Vice Chairperson, Secretary General, Deputy Secretary generals, Treasurer General , Deputy General, Envoys, Secretary for information and organizing secretary.

  2. The functions of the steering Committee are:

    1. supervise the day to day affairs of the party.

    2. Act on behalf of the National Executive Committee

    3. Make recommendations to National Executive Committee on any matter within its competence including dismissal of any member from the national executive committee.

    4. Implement decisions of the National Executive Committee.

    5. Do any such other act as may be necessary for the achievement of the objectives of the party.

    FUNCTIONS OF THE PRESIDENT

    The president shall be responsible for;
    1. Monitor and keep under constant review the implementation of all the decisions of the National Executive Committee.

    2. Submit, from time to time recommendations to the steering committee.

    3. Do any such other thing as the steering committee may direct.

    The Deputy Presidents shall;
    1. Deputize for the President

    2. perform such other acts as may be assigned by the steering committee

22. THE NATIONAL DELEGATE'S CONFERENCE

The National Delegates Conference shall be the supreme organ of the party.

There shall be National Delegates Conference whose membership consists of the following:

  1. the chairperson

  2. the vice chairpersons

  3. four representatives from each of the special interest groups

  4. all members of the national executive committee

  5. the Chairperson, General Secretary and Secretary for mobilization from each district

  6. all member of parliament

  7. two representatives from each parliamentary constituency one of whom shall be a woman

  8. eight eminent members of the party nominated by the National Council and approved by the NDC.

The vice chairpersons shall deputise for the chairperson

The tenure of the National Delegates Conference shall be five years and it shall meet at least once every three years.

FUNCTIONS OF THE NATIONAL DELEGATES CONFERENCE SHALL BE;
  1. At its first sitting elect the National Executive Committee

  2. Determine from time to time programmes and policies of the party and take position on any matter

  3. Receive, discuss and make decisions on reports from any organ of the Party

  4. Consider the annual reports of the National Council.

  5. Set up a campaign task force in an election year.
The national delegates' conferences shall meet once every three years on such date and at such place as the National Delegates Conference may determine provided that a special delegates conference may be convened at any time to consider urgent matters.

The chairperson shall convene a special National Delegates Conference whenever the Chair, and his/her Vices decide, or Executive Committee so request, or where demand for such meeting is made by one half of the District Executive Committees, or by petition of 30% of the delegates from at least 50% of all districts in Uganda.


CHAPTER 6

23. SPECIAL ORGANS

PARTY LEAGUES

  1. There shall be party Leagues formed by;

    1. Youth members of the party;

    2. Women members of the party

    3. Party members with disabilities;

    4. Workers league

  2. The Party League shall be constituted at the polling area, Sub-county, District and National Levels and shall have organs at such levels.

  3. Each party league organ shall have a Chairperson, Deputy Chairperson, Treasurer and a Secretary.

  4. Each league organ shall have a constitution to manage its affairs

24. STANDING COMMITTEES

  1. The committee on discipline and appointments

    The committee shall be composed of the Chairperson who shall be the 1st Vice chairperson of the national conference, organizing Secretary and four committee members elected by the National Conference on recommendation of the National Executive Committee

    The functions of the committee shall be:

    To enforce the Code of Conduct

    To do such other things as the National council may from time to time direct


  2. Finance Committee and welfare

    The committee on finance shall consist of the national treasurer, deputy national treasurer, secretary general, organizing secretary, two members of the national executive committee elected annually by the National council the director finance and administration, and the senior administrative officer who shall be secretary to the committee while the treasurer shall be chairperson of the committee.

    The functions of the committee shall be to:

    Fundraise for the party.
    Supervise the auditing of the party accounts.
    Make provision for the mechanism, which ensures accountability of the party funds
    Perform any other functions, which the executive committee may assign it.

  3. The Electoral committee

    The Electoral Committee shall be composed of not less than three members nominated, seconded and defended at the National Conference.

    The functions of the Committee shall be:

    1. To prepare ballot papers.

    2. To make provisions for ballot boxes or other mans of secret voting.

    3. To create machinery for counting of ballot papers and the effective supervision of the counting

    4. To establish procedures for voting and determining any dispute raised in regard to elections and election procedures, and to determine how any tied vote should be resolved.

    5. To liaise with the Electoral Commission on electoral matters.

    1. There is hereby established a national Election Tribunal whose chairperson shall be deputy President and shall comprise of the secretary for mobilization, information, a representative of the disciplinary committee and Chairman of the Legal Committee.

    2. The function of the Committee shall be to resolve disputes arising out of party elections.

    3. The lower organs of the party shall have elections tribunals at the sub county and district level and shall be constituted in the same manner as the national Election tribunal save for the chairperson of the legal committee


  4. The mobilization and recruitment committee

    The committee shall comprise of 10 members under the Chairmanship of the organizing secretary

    The functions of the committee shall, be:
    To recruit and enroll members for the party
    To mobilize party supporters.

THE SECRETARY GENERAL
  1. The Secretary General shall be:

    1. The principal executive officer of the party

    2. The head of the secretariat

    3. Secretary to Delegates conference and shall

    4. carry out such as activities as may be assigned from time to time.


  2. The Deputy Secretaries General shall

    1. Deputize for the Secretary General

    2. Perform such other duties as may be assigned by the National Executive Committee.

24. National Secretariat

The Party shall have a national secretariat under the direct supervision of the Secretary General to implement the policies of the Party. The required staff shall be recruited by the appointments committee to serve on such terms as the NEC may determine. The secretariat shall provide support staff for the Party National offices.

The National Secretariat shall consist of the:

Executive Secretary
Legal officer
Finance and Administration officer
Research and policy officer.

3. The office of the Secretary General shall be on a full time basis and he or she shall not hold any other office.

4. The functions of the National Secretariat shall be to;

Provide secretarial and administrative services to the organs of the party.

Implement decisions of the Delegate's conferences, National Council and National Executive Committee

Prepare policy papers as instructed.

Make rules and regulations.

Carry out any other functions as may be lawfully mandated.

25. VACANCIES

Any office in the Party shall fall vacant upon occurrence of any of the following:

Death
Resignation
Dismissal
Bankruptcy adjudged by the Courts of Law
Inability to perform for any reason or absence of office when so determined by the National Executive Committee.

  1. Whenever any office falls vacant the same shall be filed in accordance with the provisions of the Constitution in respect to the procedure in which such office was first filled. Where it is impractical to do so by reason of difficulty in convening the relevant organ, a person shall be appointed by the National Executive Committee to act in that capacity pending the decision of the relevant organ

  2. An office in the party shall fall vacant if the relevant organ passes a vote of no confidence in the holder of the office following the procedure set out under rules of procedure prescribed by the National Executive Committee

  3. If the vacancy cannot be immediately filled by reason of any Constitutional requirement the office shall be filled by the next senior personnel in rank.

CHAPTER SEVEN

26. MEETINGS

The National Conference, which meets once every two years, shall require three months notice but a Special National Conference shall require one months notice.

The District Conference shall meet bi-annually and shall require two weeks notice.

The Constituency conference shall meet bi-annually and shall also require a two weeks notice.

All Executive Committees shall meet at least quarterly and require one week's notice.

The quorum of all meetings shall be one third.

A meeting may transact business notwithstanding vacancies in the membership.

Decisions shall be by consensus where possible and by simple majority if consensus is not reached within reasonable time.


27. TERM OF OFFICE

The term of office of all Party officials except the President and Deputy Presidents shall be four year renewable only once.

The term of office of the President and Deputy Presidents shall be 5 years. PROVIDED that the President shall be eligible to re-election but subject a two term limit.


28. PARTY PRIMARY ELECTIONS

The following shall constitute the Electoral College for Party Primaries where need arises in the general elections;

  1. Elections of Parish Chairpersons and Sub-County Councillors: The Electoral College shall be Chairpersons of the Polling Area Branches and members of Parish Executive Committees;

  2. Elections of Sub-County Chairpersons and District Councillors: The Electoral College shall be Chairpersons of the Polling Area Branches, all members of the Parish Executive Committees and members of the Sub- County Executive Committees.

  3. Elections of Constituency MPs: The Electoral College shall be Chairpersons of the Polling Area Committees, all members of the Parish Executive Committees, members of the Sub County Executive Committees and members of the Constituency Executive Committee.

  4. Elections of District Chairpersons and District Women MPs: The Electoral College shall be all members of the sub-county Executive Committees, members of the Constituency Executive Committee and members of the District Executive Committees.

CHAPTER EIGHT

29. PARTY FUNDS

  1. The Party funds shall be drawn from:

    Membership subscriptions
    Donations
    Fundraising
    Interest from savings
    Publications and promotional items
    Investments
    Loans and credit
    Any other function as the delegates conference my prescribe

  2. The finances of the Party shall be raised, managed and expended in accordance with procedures and regulations approved by the Executive Committee and ratified by the National Conference.

  3. The Party shall operate bank accounts, in accordance with financial regulations

  4. The party shall have authority to borrow funds for its activities

  5. The accounts of the Party shall be audited annually

CHAPTER NINE

30. MISCELLANEOUS PROVISIONS

  1. Partnerships

    The Party shall enter into principled partnerships with other organizations and interest groups for purposes of attaining its objectives, mission and goals.

  2. Power to make Rules

    The National Executive Committee may through a 2/3 majority make and amend rules and regulations

  3. The Seal

    The Party shall have a seal reflecting its name and symbol and may be fixed on Party documents as may be prescribed in the Rules

31. AMENDMENT

This constitution may be amended by two thirds (2/3) majority of all members of the national conference.

  1. A new amendment may be proposed by the National Executive committee to the National Council, which may give its approval for debate and decision by the Delegates conference.

  2. Any member may propose amendment of the constitution to National Executive if such amendment is supported by at least twenty five delegates.

  3. No amendment shall be introduced in the National conference unless the proposer has given a 3 months notice of the proposed amendment in writing to the National Council and circulated the same to all District Committees

  4. The proposed amendment may be amended without notice with the approval of the chairman of conference.

32. DISSOLUTION:

The national conference or the special conference may dissolve the party by two thirds (2/3) majority of all delegates of the national council and transfer the assets and liabilities of the party.

33. ARBITRATION:

Members of the concerned organ shall resolve any dispute arising out of or connected with the interpretation of this constitution amicably. Where amicable resolution fails the Legal committee shall refer the dispute to arbitration. The decision of the committee shall be final and binding.
